① 이용약관 서비스 전체(웹 플랫폼 + AI 모듈)

제1조 (목적)

이 약관은 훈검항업(이하 "회사")이 제공하는 D-tect AI 외벽점검 플랫폼 및 관련 소프트웨어(이하 "서비스")의 이용 조건과 회사·이용자 간 권리·의무를 정합니다.

제2조 (정의)

  1. "서비스": 웹 플랫폼(hungum-ai.com), D-tect AI 모듈(설치형 처리 프로그램), 관련 저장·분석·보고서 기능 일체.
  2. "소속(조직)": 서비스 내에서 프로젝트·데이터를 공유하는 회사/기관 단위. 소유자·관리자·편집자·뷰어 등 권한 등급을 가집니다.
  3. "콘텐츠": 이용자가 업로드하는 드론 사진, 3D 모델, 표기·측정 데이터 및 이로부터 생성된 검출 결과·보고서.
  4. "라이센스 코드": D-tect AI 모듈을 특정 PC(좌석)에서 활성화하는 인증 코드.

제3조 (약관의 게시와 개정)

  1. 회사는 이 약관을 서비스 초기 화면 또는 연결 화면에 게시합니다.
  2. 회사는 관련 법령을 위배하지 않는 범위에서 약관을 개정할 수 있으며, 개정 시 적용일자와 사유를 명시하여 적용일 7일 전(이용자에게 불리한 변경은 30일 전)부터 공지합니다.

제4조 (계정과 소속)

  1. 가입은 이메일 인증 기반이며, 이용자는 정확한 정보를 제공해야 합니다.
  2. 신규 소속을 만드는 이용자는 해당 소속의 소유자가 되며, 초대 코드로 가입한 이용자는 소속 소유자/관리자의 승인 후 서비스를 이용할 수 있습니다.
  3. 계정·라이센스 코드의 관리 책임은 이용자(및 소속)에게 있으며, 제3자 공유로 인한 불이익은 회사가 책임지지 않습니다.

제5조 (서비스의 제공·변경·중단)

  1. 회사는 안정적 서비스 제공을 위해 노력하며, 정기 점검·긴급 보수·클라우드 사업자 장애 등으로 일시 중단될 수 있습니다.
  2. 회사는 서비스의 일부 기능을 개선·변경할 수 있으며, 중대한 변경은 사전 공지합니다.

제6조 (AI 분석 결과의 성격 — 중요)

  1. 서비스의 균열 검출·측정(길이·폭)·물량산출 결과는 인공지능 기반 분석의 보조 자료이며, 오검출·미검출·측정 오차가 존재할 수 있습니다.
  2. 안전진단·감리·보수 판단 등 최종 의사결정과 그 결과에 대한 책임은 자격을 갖춘 전문가와 이용자에게 있습니다. 회사는 분석 결과의 완전성·정확성을 보증하지 않습니다.
  3. 측정값의 정확도는 촬영 조건(RTK, 거리, 각도, 조도 등)에 따라 달라지며, 회사가 제공하는 촬영 가이드 준수를 권장합니다.

제7조 (콘텐츠의 권리와 책임)

  1. 이용자가 업로드한 콘텐츠의 권리는 이용자(또는 정당한 권리자)에게 있습니다.
  2. 회사는 서비스 제공(저장, 분석, 3D 처리, 보고서 생성, 품질 개선)에 필요한 범위에서 콘텐츠를 처리할 수 있습니다. 또한 회사는 서비스 품질 및 검출 정확도 향상을 위해 업로드된 콘텐츠를 AI 검출 모델의 학습·개선에 활용할 수 있습니다(가입 시 동의 범위 내). 이 경우 콘텐츠에 포함될 수 있는 개인 식별정보(얼굴·차량번호 등)는 비식별 처리합니다.
  3. 이용자는 촬영물에 대한 적법한 권한(건물 소유자 동의, 드론 비행·촬영 허가 등)을 보유해야 하며, 제3자의 초상·차량번호 등 개인정보가 포함되지 않도록 조치할 책임이 있습니다.

제8조 (금지행위)

  1. 타인의 계정·라이센스 코드 도용, 무단 공유
  2. 서비스·모듈의 역설계, 무단 복제·재판매, 자동화 수단을 통한 비정상 접근
  3. 법령 위반 촬영물 또는 권리 침해 콘텐츠 업로드
  4. 서비스 운영을 방해하는 행위

제9조 (요금)

현재 서비스는 무료로 제공되며 별도의 요금제가 없습니다. 향후 유료로 전환하거나 요금제를 도입할 경우 본 조항을 개정하고 적용일 전에 사전 고지합니다.

제10조 (계약 해지와 데이터 보관)

  1. 이용자는 언제든지 탈퇴할 수 있으며, 소속 소유자는 소속 삭제를 요청할 수 있습니다.
  2. 해지·삭제 시 콘텐츠는 1년의 유예기간 후 삭제됩니다. 법령상 보존 의무가 있는 정보는 예외로 합니다.

제11조 (책임의 제한)

  1. 회사는 천재지변, 클라우드 사업자 장애 등 불가항력으로 인한 손해에 책임지지 않습니다.
  2. 회사의 배상 책임은 법령이 허용하는 범위에서 최근 3개월간 이용자가 지불한 이용요금 총액을 한도로 합니다. 고의·중과실은 예외입니다.

제12조 (준거법·관할)

이 약관은 대한민국 법률에 따르며, 분쟁은 민사소송법상 관할 법원에 제기합니다.

② D-tect AI 모듈 소프트웨어 사용권 계약(EULA) 설치형 프로그램

제1조 (허여되는 권리)

회사는 이용자에게 D-tect AI 모듈(이하 "소프트웨어")을 발급된 라이센스 코드당 PC 1대에서 서비스 이용 목적으로 사용할 수 있는 비독점적·양도 불가 사용권을 부여합니다. 소프트웨어의 소유권과 지식재산권은 회사에 있습니다.

제2조 (좌석과 기기 이동)

  1. 라이센스 코드는 최초 활성화된 PC에 귀속됩니다(좌석 = 기기).
  2. 새 PC에서 동일 코드를 활성화하면 기존 PC의 활성화는 자동 해제될 수 있습니다.

제3조 (제한)

  1. 역설계·디컴파일·재배포·임대·재판매 금지
  2. 모델 가중치 등 구성요소의 추출·전용 금지
  3. 기술적 보호조치 우회 금지

제4조 (자동 업데이트)

소프트웨어는 기능 개선·보안을 위해 자동으로 업데이트될 수 있습니다. 이용자는 이에 동의하며, 원치 않을 경우 사용을 중단할 수 있습니다.

제5조 (처리 데이터)

소프트웨어는 이용자 소속의 사진·모델 데이터를 처리하며, 처리 결과는 소속 계정으로 저장됩니다. 소프트웨어는 라이센스 검증·업데이트 확인을 위한 최소한의 정보를 서버와 통신합니다.

제6조 (제3자 구성요소)

소프트웨어는 오픈소스 등 제3자 구성요소를 포함할 수 있으며, 해당 라이선스 고지는 소프트웨어 설치 폴더의 NOTICE 파일에서 확인할 수 있습니다.

제7조 (보증의 부인·책임 제한)

소프트웨어는 "있는 그대로" 제공되며, 이용약관 제6조(AI 분석 결과의 성격)와 제11조(책임의 제한)가 동일하게 적용됩니다.

③ 개인정보처리방침 개인정보보호법 기준

1. 수집하는 개인정보와 목적

  1. 회원 가입·관리: 이메일, 비밀번호(암호화 저장), 이름, 전화번호(선택), 소속 정보(회사명·주소·전화) — 계정 식별, 소속 승인·권한 관리
  2. 서비스 제공: 업로드 콘텐츠(사진·모델·표기), 처리 이력, 라이센스 활성화 기기 정보 — 분석·저장·보고서 제공, 좌석 관리
  3. 안전·보안: 접속 기록(IP, 일시), reCAPTCHA 판정 값 — 부정 가입·비정상 접근 방지

2. 보유·이용 기간

  1. 회원 정보: 탈퇴 시까지(탈퇴 후 1년 유예 후 파기)
  2. 콘텐츠: 소속 삭제 또는 삭제 요청 시까지
  3. 접속 기록: 통신비밀보호법에 따라 3개월 이상 보관 후 파기

3. 처리 위탁과 국외 이전 — 중요

서비스 운영을 위해 다음 클라우드 사업자에게 처리를 위탁하며, 데이터가 국외 서버에 저장·처리될 수 있습니다.

  1. Google LLC (Firebase Authentication·Firestore, reCAPTCHA) — 계정 인증·데이터베이스·봇 방지 미국 등
  2. Cloudflare, Inc. (Pages·Workers·R2) — 웹 호스팅·파일 저장 미국 등 글로벌 엣지
  3. RunPod, Inc. (Serverless GPU) — 클라우드 크랙 검출·투영 처리 미국 등

4. 제3자 개인정보가 포함된 촬영물

드론 촬영물에는 제3자의 초상, 차량번호 등이 우연히 포함될 수 있습니다. 이용자는 관련 법령을 준수하여 촬영·업로드해야 하며, 회사는 삭제 요청 창구(hugdrone@gmail.com)를 운영합니다.

5. 파기 절차

보유 기간 경과 또는 목적 달성 시 전자 파일은 복구 불가능한 방법으로 삭제합니다.

6. 정보주체의 권리

이용자는 자신의 개인정보에 대한 열람·정정·삭제·처리정지를 요구할 수 있으며, 아래 연락처로 요청하면 지체 없이 조치합니다.

7. 안전성 확보 조치

  1. 비밀번호 일방향 암호화, 통신 구간 암호화(HTTPS)
  2. 권한 등급 기반 접근 통제, 접근 기록 보관
  3. 클라우드 사업자의 보안 인증 활용

① Terms of Service Entire service (web platform + AI Module)

Article 1 (Purpose)

These Terms govern the conditions of use of the D-tect AI Facade Inspection platform and related software (the "Service") provided by Hungum Hangup Co. (the "Company"), and the rights and obligations between the Company and users.

Article 2 (Definitions)

  1. "Service": the web platform (hungum-ai.com), the D-tect AI Module (installed processing program), and all related storage, analysis, and reporting features.
  2. "Organization": a company/institution unit sharing projects and data within the Service, with role tiers such as Owner, Admin, Editor, and Viewer.
  3. "Content": drone photographs, 3D models, annotation/measurement data uploaded by users, and detection results and reports generated from them.
  4. "License Code": an activation code that enables the D-tect AI Module on a specific PC (seat).

Article 3 (Posting and Amendment)

  1. The Company posts these Terms on the Service's initial screen or a linked page.
  2. The Company may amend these Terms within the bounds of applicable law, announcing the effective date and reasons at least 7 days in advance (30 days for changes unfavorable to users).

Article 4 (Accounts and Organizations)

  1. Registration is based on email verification; users must provide accurate information.
  2. A user who creates a new Organization becomes its Owner; users joining via invitation code may use the Service after approval by the Organization's Owner/Admin.
  3. Users (and Organizations) are responsible for safeguarding accounts and License Codes; the Company is not liable for losses caused by sharing them with third parties.

Article 5 (Provision, Change, and Suspension)

  1. The Company strives for stable operation; the Service may be temporarily suspended for maintenance, urgent repairs, or cloud-provider outages.
  2. The Company may improve or change features; material changes will be announced in advance.

Article 6 (Nature of AI Results — Important)

  1. Crack detection, measurements (length/width), and quantity take-off results are assistive materials produced by AI analysis and may contain false positives, missed detections, and measurement errors.
  2. Final decisions — including safety assessment, supervision, and repair judgments — and responsibility for their outcomes rest with qualified professionals and the user. The Company does not warrant the completeness or accuracy of analysis results.
  3. Measurement accuracy depends on capture conditions (RTK, distance, angle, lighting); following the Company's shooting guide is recommended.

Article 7 (Rights and Responsibilities for Content)

  1. Rights to uploaded Content belong to the user (or the rightful holder).
  2. The Company may process Content to the extent necessary to provide the Service (storage, analysis, 3D processing, report generation, quality improvement). The Company may also use uploaded Content to train and improve its AI detection models to enhance quality and accuracy, within the scope consented to at sign-up. In such cases, any personal identifiers that may be contained in the Content (faces, license plates, etc.) are de-identified.
  3. Users must hold lawful rights to the footage (building-owner consent, drone flight/filming permits, etc.) and are responsible for ensuring no third-party personal data (faces, license plates) is included.

Article 8 (Prohibited Acts)

  1. Misappropriating or sharing others' accounts or License Codes
  2. Reverse engineering, unauthorized copying/resale, abnormal automated access
  3. Uploading unlawful footage or rights-infringing content
  4. Interfering with Service operations

Article 9 (Fees)

The Service is currently provided free of charge with no pricing plan. If the Company later introduces paid plans, it will amend this Article and provide advance notice before the effective date.

Article 10 (Termination and Data Retention)

  1. Users may withdraw at any time; an Organization Owner may request deletion of the Organization.
  2. Upon termination/deletion, Content is deleted after a grace period of 1 year, except where retention is legally required.

Article 11 (Limitation of Liability)

  1. The Company is not liable for damages caused by force majeure, including natural disasters and cloud-provider outages.
  2. To the extent permitted by law, the Company's aggregate liability is capped at the total fees paid by the user during the preceding 3 months, except in cases of willful misconduct or gross negligence.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by the laws of the Republic of Korea; disputes shall be brought before the competent court under the Civil Procedure Act.

Addendum — Effective date: 1 August 2024

② D-tect AI Module EULA Installed program

Article 1 (License Grant)

The Company grants the user a non-exclusive, non-transferable license to use the D-tect AI Module (the "Software") on one PC per issued License Code for the purpose of using the Service. Ownership and intellectual property rights in the Software remain with the Company.

Article 2 (Seats and Device Transfer)

  1. A License Code is bound to the PC on which it is first activated (seat = device).
  2. Activating the same code on a new PC may automatically deactivate the previous PC.

Article 3 (Restrictions)

  1. No reverse engineering, decompilation, redistribution, rental, or resale
  2. No extraction or diversion of components, including model weights
  3. No circumvention of technical protection measures

Article 4 (Automatic Updates)

The Software may update automatically for improvements and security. Users consent to this; those who do not may discontinue use.

Article 5 (Processed Data)

The Software processes the user Organization's photo/model data; results are stored to the Organization's account. The Software communicates minimal information with servers for license verification and update checks.

Article 6 (Third-Party Components)

The Software may include third-party components such as open-source software; notices are available at the NOTICE file in the Software's installation folder.

Article 7 (Disclaimer and Limitation)

The Software is provided "AS IS"; Articles 6 (Nature of AI Results) and 11 (Limitation of Liability) of the Terms of Service apply equally.

Addendum — Effective date: 1 August 2024

③ Privacy Policy Based on the Korean Personal Information Protection Act

1. Personal Data Collected and Purposes

  1. Registration/administration: email, password (stored encrypted), name, phone (optional), organization info (name/address/phone) — account identification, organization approval and role management
  2. Service provision: uploaded Content (photos/models/annotations), processing history, license-activation device info — analysis, storage, reporting, seat management
  3. Safety/security: access logs (IP, timestamps), reCAPTCHA assessments — preventing fraudulent sign-ups and abnormal access

2. Retention Period

  1. Member data: until withdrawal (destroyed after a 1-year grace period)
  2. Content: until organization deletion or a deletion request
  3. Access logs: retained at least 3 months per the Protection of Communications Secrets Act, then destroyed

3. Processing Delegation and Cross-Border Transfer — Important

Operation is delegated to the following cloud providers; data may be stored and processed on servers outside Korea.

  1. Google LLC (Firebase Authentication/Firestore, reCAPTCHA) — authentication, database, bot prevention USA, etc.
  2. Cloudflare, Inc. (Pages/Workers/R2) — web hosting, file storage USA and global edge
  3. RunPod, Inc. (Serverless GPU) — cloud crack detection/projection processing USA, etc.

4. Footage Containing Third-Party Personal Data

Drone footage may incidentally include third parties' faces or license plates. Users must film and upload in compliance with applicable law; the Company operates a deletion-request channel (hugdrone@gmail.com).

5. Destruction

Upon expiry of the retention period or fulfillment of purpose, electronic files are deleted irrecoverably.

6. Data Subject Rights

Users may request access, correction, deletion, or suspension of processing of their personal data via the contact below; the Company will act without delay.

7. Security Measures

  1. One-way password hashing; encrypted transport (HTTPS)
  2. Role-based access control; access-log retention
  3. Use of cloud providers' security certifications
